6 दिसम्बर आज़ाद हिन्दुस्तान के इतिहास का एक ऐसा दिन, जिसे पूरी दुनिया कभी भूला न सकेगी। हिन्दुस्तान के धर्म-निरपेक्ष छवि पर एक ऐसा बदनुमा दाग, जिसे सदियों तक मिटाया न जा सकेगा। अनेकता में एकता और गर्व से कही जाने वाली गंगा-जमुनी संस्कृति के चार सौ वर्ष पुराने धरोहर को दिन-दहाड़े ढ़ा दिया गया। एक पवित्र इबादतगाह को शहीद कर दिया गया। एक पूरी क़ौम रोती रही, कराहती रही, और हृदय रखने वाली इंसानियत तड़पती रही।
बाबरी मस्जिद विध्वंस की घटना को 17 वर्ष बीत गए हैं, और यह दिन संगठनों व राजनेताओं के लिए विरोध-प्रदर्शन, धरना, जलसा-जुलूस का दिन बन कर रह गया। इस तरह इन्हें हर साल अपनी टोपी-शिरवानी की गर्द झाड़ने और अपनी भाषणबाज़ी का ज़ौहर दिखाने का मौका मिलने लगा।
आलम तो यह है कि लिब्राहन आयोग ने अपनी रिपोर्ट पेश कर दी है। इस रिपोर्ट को लाने में लिब्राहन साहब को 17 वर्ष लग गए। इसमें देश की जनता का अथाह धन बर्बाद हुआ। लोकसभा- राज्यसभा में बहस भी पूरी हो गई। दिल्ली विधानसभा में तो मार-पीट तक की नौबत आ गई। पर नतीजा हुआ ढ़ाक के तीन पात।
खैर मामला अभी अदालत में है। लेकिन अब आपको तय करना है कि इस पूरे विवाद का क्या हल है...? इसके वजहों से दो भाईयो, दो धर्मों के बीच जो दूरियां बढ़ी हैं, उसे कैसे पाटा जाए...? कैसे खत्म किया जाए...?

‘हम जानेंगे, हम जिएंगे’ के जनक का चला जाना...


पत्रकारिता का छात्र होने के नाते प्रभाष जी से परिचित होना स्वभाविक है। लेकिन उन्हें करीब से जानने का अवसर तब प्राप्त हुआ, जब मैं सूचना के अधिकार अभियान से जुड़ा। इस दौरान उनसे कई बार मिलने और बातचीत करने का अवसर भी प्राप्त हुआ। जब मैंने अपने कॉलेज के प्रोजेक्ट के रूप में सूचना के अधिकार पर रिसर्च करने की बात कही थी तो वो काफी खुश हुए थे और मेरी काफी हौसला-अफजाई भी की। उन्होंने मुझे यह भी सलाह दी कि इस अधिकार का ज़्यादा से ज़्यादा इस्तेमाल पत्रकारिता के लिए करूं।

सच पूछे तो सूचना के इस अधिकार को देश में नाफिज़ कराने में सबसे अहम रोल प्रभाष जी का ही रहा है। वो आरंभ से ही इसके तमाम आंदोलनों से जुड़े रहे और लिखते रहे, और जितना उन्होंने इस अधिकार पर लिखा, शायद ही किसी ने इतना लिखा हो। ‘हम जानेंगे, हम जिएंगे’ नारा के जनक प्रभाष जी ही थे। उन्हीं की वजह से सूचना के अधिकार आंदोलनों को अखबारों में जगह भी मिल पाती थी।

6 अप्रैल 1996 को ब्यावर में शुरू हुए 40 दिन के ऐतिहासिक धरने में उन्होंने कहा कि ‘सेठ मकान बनवाता है तो शाम को मुनीम से हिसाब मांगता है। लोकतंत्र में जनता राजा है। यह सरकार से हिसाब मांगती है तो उसे मना नहीं किया जा सकता है।’

इस धरने में प्रभाष जी न सिर्फ शामिल हुए बल्कि कुलदीप नैय्यर और देश के कई पत्रकारों में शामिल करवाया था। एक जगह खुद प्रभाष जी लिखते हैं- ‘हम इकट्ठे तब राज्यसभा के बिल पर विचार शुरू ही हुआ था। हम यानी सूचना के जन अधिकार पर राष्ट्रीय अभियान के लोग। हमारे बीच अरूणा राय नहीं थी, क्योंकि वे अपनी बीमार मां के साथ तिलोनिया थीं। प्रशांत भूषण भी नहीं थे, क्योंकि सुप्रीम कोर्ट में उनका कोई केस चल रहा था। बाकी हम सब थे और एक तरह की धन्यता के भाव में थे।’

एक जगह और लिखते हैं- ‘जब हमने न्यायमूर्ति सावंत की अध्यक्षता वाली प्रेस परिषद के जरिए सूचना के अधिकार पर राष्ट्रीय सम्मेलन करवाया था तो उसमें भूतपूर्व प्रधानमंत्री विश्वनाथ प्रताप सिंह ने आंख खोल देने वाला भाषण दिया था। उनने कहा कि प्रधानमंत्री बनने के बाद सन् 90 में उनने अपने अधिकारियों को बुलाकर कहा कि सूचना के अधिकार पर अपनी पहल से एक नोट बनाया जाना चाहिए ताकि बात चलाई जा सके। काफी याद दिलाने के बाद उनके पास जो मसविदा आया उसे पढ़ने के बाद उन्हें लगा कि यह तो फालतू की कवायद होगी। मसविदा इतना पनीला था कि उसमें कितना ही दूध जाता वह दूधिया तक नहीं होता।’

8-10 अक्टूबर 2004 को सूचना के अधिकार पर दिल्ली में हुए राष्ट्रीय अधिवेशन में भी वो शामिल रहे और उन्होंने अपने भाषण में कहा- ‘..... लेकिन एक बात हमें साफ तौर पर याद रखनी होगी कि कितना ही कानून बन जाए या सरकार इसके लिए तैयार हो जाए लेकिन यह तब तक सफल नहीं होगा जब तक कि लोग इसके लिए संघर्ष नहीं करेंगे, क्योंकि जानकारी ही सचमुच की सत्ता है। जब भी कोई किसी से जानकारी लेता है तो सत्ता छीनता है। जिस तरह अंग्रेज़ लोग भारतीयों को सत्ता नहीं सौंपना चाहते थे, वैसे ही भारतीय सत्ताधीश भी आम लोगों को सत्ता से दूर रखना चाहते हैं। अब मौका आ गया है जब हम अपने गांव, कस्बे या शहर में ‘सूचना की सत्ता’ की प्राप्ति के लिए संघर्ष छेड़ दें।’

एक जगह और वो लिखते हैं- ‘सूचना सत्ता है’ इस आधुनिक मुहावरे की जितनी अच्छी और पक्की समझ भारत की नौकरशाही को है, उतनी उन राजनेताओं को भी नहीं जो दिन-रात सत्ता के पीछे पड़े रहते हैं और उसे पाने के लिए कुछ भी कर सकते हैं। अपने देश की नौकरशाही जानती है कि स्थायी वही है। राजनेता और सरकारें तो आती-जाती रहती हैं। वह यह भी जानती है कि राज चलाने के लिए ही नहीं, धन बनाने के लिए भी राजनेताओं को उन पर निर्भर रहना पड़ता है। राजनेता सार्वजनिक संसाधनों की जैसी और जितनी लूट मचाते हैं, उससे ज़्यादा नौकरशाही करती है। वह भ्रष्ट राजनेताओं के प्रति कितनी उत्तरदायी होती होगी इसका अंदाज़ ही लगाया जा सकता है। सूचना और जानकारी पर असली कब्ज़ा नौकरशाही का होता है।

‘भारत में मीडिया, विधायिका और न्यायपालिका से कहीं ज़्यादा सूचना का अधिकार लोगों को चाहिए क्योंकि मीडिया, विधायिका और न्यायपालिका तो किसी तरह सूचनाएं फिर भी पा लेती हैं, लेकिन एक खेतिहर मजदूर जान नहीं पाता कि क्यों उसे रोज़गार नहीं मिला और कैसे उसके नाम पर उसकी मजदूरी दूसरा कोई खा गया जो मजदूरी नहीं करता।’

आम आदमी और खेतिहर मजदूरों का जितना दुख-दर्द प्रभाष जी ने महसूस किया। काश उसका कुछ प्रतिशत भी आज की मीडिया समझ पाती। आज आलम तो यह है कि इन गरीबों की खबरें भी पैसे लेकर छापी जाती हैं। पर प्रभाष जी खबरों के प्रकाशन में धन लेने की नई प्रवृति के विरोधी थे, बल्कि इन दिनों वो सूचना के अधिकार पर काम करने वालों को लेकर भी चिंचित थे, क्योंकि उनका मानना था कि इन लोगों ने सूचना का कारोबार चलाना शुरू कर दिया है। आम लोगों से अवार्ड के नाम पर खबरें लेकर मीडिया को बेची जा रही हैं। वो सूचना के अधिकार पर लोगों व सरकारी अधिकारियों यानी नौकरशाहों को अवार्ड दिए जाने के भी पक्षधर नहीं थे, जिस अवार्ड के लिए पूंजीपतियों का पैसा लगाया जा रहा है। खैर, प्रभाष जी से डेढ़-दो महीने पहले मैंने फोन पर बात की थी। दरअसल, मैं सूचना के अधिकार पर लिखी अपनी पुस्तक के लिए उनका इंटरव्यू करना चाह रहा था। प्रभाष जी इसके लिए तैयार भी थे, लेकिन उन्होंने मुझे कुछ दिन इंतज़ार करने को कहा। उन्होंने बताया कि ‘मेरी तबीयत आज कल ठीक नहीं चल रही है, जैसे ही मैं ठीक होता हूं, आपको बुला लूंगा।’ बात-बात में मैंने आर.टी.आई. अवार्ड पर उनकी राय जानने की कोशिश की। इस मामले में वो अरविंद केजरीवाल से काफी नाराज़ दिखे। उन्होंने मुझसे कहा कि आपने तो आर.टी.आई. खूब डाली हैं, क्या आपने भी इस अवार्ड के लिए अपना नॉमिनेशन किया है? जब मैंने उन्हें बताया कि मैं भी अवार्ड के पक्ष में नहीं हूं, बल्कि उसका विरोध कर रहा हूं। मैंने खुद तो अपना नॉमिनेशन नहीं किया लेकिन मेरे कई दोस्तों ने मेरा नॉमिनेशन किया था। वहां से कई सारे पत्र व फॉर्म भी आए, लेकिन मैंने उसे भरकर नहीं भेजा। मेरी इन बातों को सुनकर पूछा कि विरोध करने का क्या फायदा। फॉर्म भरकर भेज देते तो शायद कुछ पैसे-वैसे मिल ही जाते, क्योंकि आपने तो राजनीतिक दलों और बटला हाउस एनकाउंटर पर काफी अच्छा काम किया है। जब मैंने विरोध के पक्ष में अपने तर्क दिए तो वो काफी खुश हुए। मुझे सलाह दी कि इन बातों को लोगों के बीच लाना चाहिए, अन्यथा विरोध का कोई मतलब नहीं रह जाता है। यह हमारी आखिरी बातचीत थी, जिसे मैं पूरी जिंदगी भूल नहीं पाउंगा। मुझे अब भी यक़ीन नहीं होता कि वो मुझे छोड़कर सदा के लिए जा चुके हैं। मैं बार-बार यही सोचता हूं कि आज फोन करके उनसे मिलने चला जाउं। काश ये मुमकिन हो पाता......

No right This....

Information officers are using a ploy to deter RTI applicants from seeking details that may embarrass the government. To discourage, they demand exorbitant amount of money ostensibly as an expense for ferreting out the information. And, it's all officialSadiq Naqvi Delhi.


It is a travesty of citizen's rights. For a piece of information that they have every right to access, citizens are asked to shell out a lakh of rupees. It has been four years since the Right to Information (RTI) was made into a law. But bureaucratic unease at sharing information is making a nonsense of it. Public information officers have flourished by keeping information under wraps. This is proving to be a major obstacle in the speedy implementation of this law that gives greater meaning to our democracy.
The ugly truth after four years of RTI's existence: there is just 27 per cent chance of getting information even after approaching government-appointed commissions following an appeal or complaint under RTI. This was revealed in a report released by RTI Awards Secretariat recently. A study by PricewaterhouseCoopers reveals that more than 75 per cent of the applicants were dissatisfied with the quality of information received.
The situation is getting worse as there are reports of government mulling over amendment of the RTI Act that could actually make it weaker. Sources reveal that the department of personnel and training (DoPT) is opposed to greater transparency, which it considers subversive. Noted activist, Aruna Roy, said, "How can DoPT, which deals with career interests of bureaucrats, be the parent department for disclosing information? The government wants to exempt file notings from being disclosed. This will destroy the very essence of RTI."
Activists feel that instead of amending the act, the government should first implement the present act fully. The government's plan to reject frivolous petitions, activists alleged, is a ruse to reject any application that they consider inconvenient. A Central Information Commission (CIC) official denied that there is any such plan. "The government has time and again made it clear that the act will be made stronger. There is nothing to worry," he told Hardnews.
The Supreme Court has made it clear that the fundamental right to freedom of speech guaranteed under Article 19 (1) (a) of the Constitution was based on the foundation of the right to know about the activities of the State. The effect was seen in the 2002 ruling of the SC, which made it mandatory for aspiring MPs and MLAs to declare their assets and criminal record before contesting. Thus, the Right to Information was seen as a weapon to weed out corruption and bring in more accountability in the functioning of the State.
RTI activist Arvind Kejriwal said, "The culture of secrecy which we inherited from our colonial rulers is proving to be an incentive for government officers." RTI is perceived as an encroachment on their power and style of functioning where no questions were asked and no action taken.
A recent report released by the RTI Assessment and Analysis Group (RaaG) and the National Campaign for People's Right to Information (NCPRI) reveals that in about 55 to 60 per cent cases, information was provided under the RTI Act from various government departments. Rest of the time, petitioners were even threatened, chased out and ignored.
Assam is at the bottom of the table with 23 per cent and Meghalaya tops the list with information being provided in 83 per cent of the cases. According to the report, information was given on time only in 40 out of 100 cases. Even the different bodies constituted by the government, like the information commissions, do not fare any better.
"I filed an RTI application in the Bihar state information commission (SIC) to know how many appeals and complaints they had received in December 2008. I had to make a second appeal and, finally, the information was given after a good eight months," said Afroz Alam, a student of Jamia Millia Islamia, Delhi.
Jaankari, a call centre set up in Bihar to assist in filing RTI applications, refused to provide information about how many requests it has processed. And, in this case too, second appeal had to be made.
The report released by RaaG and NCPRI shows that 40 per cent of rural and 15 per cent of urban respondents cited harassment and threats by officials as reasons for not filing RTI applications. Another 30 per cent of rural respondents said that they were discouraged by the public information officer (PIO) responsible for providing the information. "I received threats on phone after I had filed an RTI asking how much money the local MP had spent for his constituency," a student from Bihar told Hardnews on condition of anonymity.
Since RTI applicants must reveal their identity, they are threatened and at times forced to withdraw applications. There have also been cases where people were victimised for using the RTI as a tool to fight corruption. In Bihar, a petitioner was jailed for "daring" to ask information from a district collector. The collector slapped a charge of extortion and blackmail on the hapless RTI applicant. According to a senior CIC official, having a Protection of Whistleblowers Act could solve this problem.
Meanwhile, information officers are using another ploy to deter RTI applicants from seeking details that may embarrass the government. To discourage, they demand exorbitant amount of money ostensibly as an expense for ferreting out the information. And, it's all official.
Recently, when the Delhi Police was asked details about the number of children who have disappeared or stolen, the applicant was asked to shell out a huge sum. In another instance, when an employee approached the Delhi Metro Rail Corporation for internal audit reports, the chief public relations officer told him, "The information is not readily available and will require deployment of one non-supervisor, one supervisor and one assistant manager on overtime basis..." The applicant was asked to deposit Rs 17,608 for the information. The applicant withdrew his application.
Hardnews was told by the CIC official that demanding money is patently illegal. "Nobody is allowed to charge excess money. Had the applicant approached the commission, he would have got the information for a nominal charge." Kejriwal said he was asked to pay Rs 10 per order by the SIC in UP when he had asked them for orders passed by them for his study.
In the absence of training, most PIOs are clueless about what is expected of them under the RTI. According to a RaaG-NCPRI report, nearly 70 per cent of the rural PIOs spend less than one hour per week on RTI-related work. Another 30 per cent of them are not aware of the provisions of the RTI Act. Around 60 per cent of urban and rural PIOs have not been trained. Interestingly, 50 per cent of the rural PIOs do not have a copy of the RTI Act with them. Many of the PIOs cited lack of financial incentives as the reason for their disinterest.
Often, information is withheld on the pretext that it is confidential. "An RTI petition with several queries on recent controversial recommendations by the Supreme Court collegiums on appointments of its judges was not entertained by the apex court for being confidential without citing any exemption clause from the RTI Act," said Subhash Aggarwal, an RTI activist. However, another RTI petition filed at the President's secretariat with exactly the same set of questions received a good response with detailed documents, he added.
According to the RaaG-NCPRI report, 80 per cent of first appeals received no response from the first appellate authorities. Another 11 per cent were rejected and in only nine per cent cases they were partially or wholly heard.
The RTI Act is also bearing the brunt of State apathy. The government does not advertise about this so that more people get to know about it. In 2008-09, the DoPT spent Rs 7.29 crore for advertising about RTI. It had been allocated Rs 10 crore in the budget. For the year 2009-10, Rs 14.16 crore has been allocated. Till October 2009, Rs 3.55 crore has been spent.
The RaaG-NCPRI organised focal group discussions (FGD) across the country. In 20 per cent of the rural FGDs, there was only one person who knew about the RTI Act.
According to the RaaG-NCPRI report, most people got to know about RTI through newspapers, televisions or NGOs. Unfortunately, the government did not play a major role in raising awareness about RTI. Social activist, Medha Patkar, said, "There is a need to take the campaign in villages. The local officers should devise ways to inform citizens living in rural areas."
Sources in the CIC said, "Money is being spent on areas where people are already aware. Officials at the block and district levels should be engaged to raise awareness about RTI." Nearly 20 lakh RTI applications were filed in the first two-and-a-half years of RTI.
Out of 20 lakh RTI applications, nearly 16 lakh were filed by urban applicants and only four lakh applicants were from rural areas, said the RaaG-NCPRI report. Of the urban participants surveyed, only 15 per cent belonged to the economically weaker section.
If government agencies declare information as per Section 4 of the RTI Act, the burden of filing an application will be reduced. "The government has to disclose information suo moto. RTI is not succeeding because government is not implementing Section 4. It is for the government to practise what it preaches. We have time and again approached DoPT with draft rules for suo moto disclosure of information. Can you imagine what would happen if the government disclosed all information?" Aruna Roy told Hardnews.
Kejriwal said, "The government has failed to disclose information about its day-to-day dealings. The people are also at fault as they have not been able to mount pressure on the government." Also, information officers who delay in passing on information are mostly not penalised. Only 2 per cent of the PIOs have been penalised till now. "Systems are built on encouragement and not punishment. We have to be practical," said ML Sharma, information commissioner, CIC.
Whatever information disclosed by the government on its own remains restricted to websites of respective departments. According to the RaaG-NCPRI report, only 5 per cent of urban public authorities had disclosed information pertaining to their functions on notice boards. Even websites don't provide up-to-date information.
Hardnews found that the website of SIC of Madhya Pradesh has not been updated since October 7, 2008. The Gujarat SIC's website had data till March 2008. Patkar said, "RTI is a way forward in inculcating the culture of transparency and accountability which implies changing the mindset of government officials. Under Section 4 of the RTI Act, information should be given by the gram sabha and notice boards should be put in place. There should be sections in public libraries where officials of different departments can sit so that people can have easy access."

RTI in a dwindling state in Bihar....

The much hailed RTI Act passed to fight corruption and transparency in the administration has completed four years. In January 2007, Bihar’s CM Nitish Kumar declared Bihar a ‘model state’ not only for India but the whole world, when a call centre ‘Jankari’, literally meaning information, was inaugurated. Thus information from any department was just a call away or that’s how it was supposed to be.

The project was applauded by many civil rights activists and statesmen, including Sonia Gandhi and a reputed consultancy agency Price-Water Housekooper. Department of personnel and training is in fact planning to expand it to entire country. However, on ground the situation is quite different.
Earlier one would often hear “the number is not in use” or “kindly check the number” in Hindi. Even now, frequently the phone is either not received or is disconnected.

Ten rupees, as application fees are charged on the telephone bill. Still many times the information officer actually ask for the application fees. Further, don’t be surprised if it takes months, or sometimes a year, for the information to reach you. Even the information provided is often incomplete. Many citizens have actually been put in jail for the crime of soliciting information under the Act.

In fact, Jankari itself appeared reluctant in providing any information. After several applications and appeals, the call centre finally provided some information relating to its ‘publicity’. But that took them more than a year.
According to information received under RTI Act-2005, on November 18, 2008 approximately Rs. 25 lakh have been spent in organizing seminars, distributing pamphlets, putting posters and hoardings and issuing post-cards. The Central government, in comparison, had spent only Rs 2 lakh till 2008.
Information provided under another application also reveals that the six-seater Jankari call centre being run by the State Electronic Development Corporation Ltd. received Rs 33,26,000 from the government while it spend Rs.34,40,586.
Besides, the State information commission has spent more than 2 crore 75 lakh rupees till 2008-2009. Still there are only two information commissioners for the entire state, while there is provision for ten commissioners, besides one Chief Information Commissioner (CIC). Interestingly, the post of CIC is vacant since October, 2008. After Justice Shashank kumar’s term ended last year, Patna High Court’s retired Chief Justice J.N.Bhatt was appointed the CIC. He had however, not yet taken charge. According to latest report, he has now refused to join. As a result more than nine thousand appeals/complains are pending.

Nitish kumar had come to power with the promise of good governance. Although he generously allotted money to the commission, it has become like any other department in the state. Unless, Information Commission and its call centre is overhauled and made more transparent and accountable, there is very little hope of any significant improvement in the system.

बिहार में सूचनाधिकार: अभी दिल्ली दूर है....

बिहार के सुशासन बाबू नीतीश कुमार ने 29 जनवरी 2007 को बिहार में सूचना अधिकार के नाम पर एक क्रांति का सूत्रपात किया था. सुशासन बाबू ने फोन के जरिए सूचना देने का क्रांतिकारी प्रयोग किया था. इस लिहाज से प्राइसवाटर हाउस कूपर्स से लेकर सोनिया गांधी तक सभी ने सुशासन बाबू की इस पहल की जमकर तारीफ की थी और भ्रष्टाचार में आकंठ डूबे बिहार को सूचना अधिकार का रोल मॉडल घोषित कर दिया था. लेकिन क्या सूचना अधिकार का यह रोल मॉडल काम कर रहा है?


देश में बढ़ते भ्रष्टाचार व अपारदर्शिता से निपटने हेतु लागू किए गए ‘सूचना के अधिकार’ को नाफिज़ हुए चार वर्ष मुकम्मल हो चुके हैं। और ये सच है कि जब भी ‘सूचना के अधिकार' का ज़िक्र होगा तो बिहार राज्य का नाम ज़रुर आएगा, क्योंकि बिहार इस मामले में सिर्फ भारत ही नहीं बल्कि नीतिश जी के लफ़्ज़ों में पूरे विश्व का ‘मॉडल स्टेट' है। हमारे देश में बिहार ही एक ऐसा राज्य जहां फोन के माध्यम से ‘सूचना के अधिकार' का आवेदन किसी भी विभाग में डाल सकते हैं। इसके लिए यहां 29 जनवरी 2007 से ‘जानकारी' नामक एक कॉल सेंटर स्थापित है। इस कॉल सेंटर की मीडिया व सिविल सोसाईटी की जानिब से खूब प्रशंसा की गई। यहां तक कि इसके लिए बिहार सरकार को कई पुरस्कारों से भी नवाज़ा गया। यही नहीं, मशहूर कंसल्टेंसी एजेंसी प्राइसवाटर हाउसकूपर्स के साथ-साथ सोनिया गांधी भी इसकी मुरीद हैं। कार्मिक मंत्रालय तो इससे इतना प्रभावित है कि इस तरह का कॉल सेंटर पूरे देश भर में शुरु करने का मन बना रही है। पर अफसोस पर्दे के पीछे की कहानी कुछ और ही है।


इस ‘मॉडल स्टेट' में इस अधिकार की जो दयनीय हालत है, शायद उसे लफ़्ज़ों में बयान नहीं किया जा सकता। बिहार के दूसरे विभागों से सूचना दिलवाने वाली ये ‘कॉल सेंटर' खुद बीमार है। शुरु के एक-डेढ़ साल तो हमें ‘ये नंबर सेवा में नहीं है' या फिर ‘डायल किया गया कृपया जांच लें' की सदा सुनाई देती रही और अब रिंग होता रहे और कोई फोन रिसीव न करे या फिर फोन उठाकर आपका फोन काट दे तो इसमें ज़्यादा हैरान होने की ज़रुरत नहीं है, और अगर आपका आवेदन दर्ज कर लिया जाए तो इस स्थिती में आप सूचना मिलने की ज़्यादा उम्मीद मत रखिएगा। हो सकता है कि फोन से दस रुपये बतौर फीस कटने के बाद भी कुछ विभाग आपसे फीस की मांग करें, या सूचना पूछने के जुर्म में जेल की हवा खानी पड़े, या फिर हो सकता है कि एक साल के बाद आपको सूचना मिले वो भी आधी।अधूरी। और अगर आपने भ्रष्टाचार के खिलाफ लड़ाई लड़ने की ठान ली है तो फिर आप लोगों के लिए स्वयं एक हास्यापद सूचना हैं।


हालत तो यह है कि सूचना उपलब्ध करवाने वाला ‘कॉल सेंटर' और ‘राज्य सूचना आयोग' खुद अपनी सूचना देना मुनासिब नहीं समझते। ऐसे में बाकी विभागों का क्या रवैया होगाए इसका अंदाज़ा आप खुद लगा सकते हैं। हालांकि नीतिश सरकार ने इस अधिकार के प्रचार व प्रसार में काफी पैसे बहाये हैं। सूचना के अधिकार के तहत काफी मेहनत व मुशक्कत के बाद 18 नवंबर 2008 को मिली सूचना के अनुसार इस अधिकार के व्यापक प्रचार।प्रसार हेतु सूचना एवं जन सम्पर्क विभागए बिहार द्वारा मेघदूत पोस्टकार्ड योजना के माध्यम से जन-जन तक पहुंचाने के लिए 1।25 लाख पोस्टकार्ड का मुद्रण किया गयाए जिस पर कुल लागत 2.50 लाख रुपये है। पोस्टर मुद्रण पर 22,500. (बाइस हज़ार पांच सौ) रुपये तथा फ्लैक्स संस्थापन के कार्य पर 52,763 (बावन हज़ार सात सौ तिरसठ) रुपये खर्च किया गया। इसके अतिरिक्त प्रखंडों के आधार पर इसके प्रचारार्थ होर्डिंगए फ्लैक्स एंव पम्पलेट निर्माण हेतु कुल 21,48,000(इक्कीस लाख अड़तालीस हज़ार) रुपये खर्च किया गया है। केन्द्रीय प्रायोजित योजना के तहत भी राज्य को कार्यशाला एंव सेमिनार के माध्यम से प्रचार.प्रसार हेतु 50,000 (पचास हज़ार) रुपये ज़िलाधिकारी पटना को मिला.


सूचना के अधिकार के तहत मिली एक अन्य सूचना के अनुसार बिहार स्टेट इलेक्ट्रॉनिक डेवलपमेंट कारपोरेशन लिमिटेड के ज़रिए आउटसोर्सिंग व्यवस्था से चलने वाली छह सीटर कॉल सेंटर को कार्मिक व प्रशासनिक सुधार विभाग, बिहार से दिनांक 25 सितम्बर 2007 को 33,26,000/- (तैतीस लाख छब्बीस हज़ार) रुपये प्राप्त हुए जबकि इसने खर्च किया 34,40,586/- (चौतीस लाख चालीस हज़ार पांच सौ छियासी) रुपये।


वहीं बिहार राज्य सूचना आयोग में वर्ष 2008-09 तक 2,75,43,072/- (दो करोड़ पचहत्तर लाख तिरालीस हज़ार बहत्तर) रुपये की राशि खर्च की गई। पर अफसोस! इतने खर्च के बावजूद ये राज्य सूचना आयोग दो ही आयुक्तों के सहारे चल रहा है, जबकि एक मुख्य सूचना आयुक्त सहित 10 आयुक्त यहां होने चाहिए। दिलचस्प बात तो यह है कि यहां मुख्य सूचना आयुक्त का पद ही खाली है, क्योंकि अक्टूबर 2008 में मुख्य सूचना आयुक्त न्यायमूर्ति शशांक कुमार सिंह सेवानिवृत हो गए और राज्य सरकार ने पटना हाईकोर्ट के सेवानिवृत मुख्य न्यायधीश जे।एन.भट्ट को मुख्य सूचना आयुक्त बनाया गया लेकिन श्री भट्ट ने आज तक मुख्य सूचना आयुक्त का पदभार ग्रहण नहीं किया। यही कारण है कि जून 2009 तक के रिपोर्ट के मुताबिक 9106 वादों की सुनवाई आयोग के समक्ष प्रक्रियाधीन है, क्योंकि सूचना के अधिकार के तहत मिली जानकारी के अनुसार अक्टूबर 2006 से जून 2009 तक आयोग में कुल 20572 वाद दर्ज गए, जिनमें से 11466 वादों का निष्पादन कर दिया गया है। सबसे दिलचस्प बात तो यह है कि हर आवेदक के द्वितीय अपील के बाद जुर्माना लगाने की बात करने वाली ये आयोग अब तक 23 जन सूचना अधिकारियों पर ही जुर्माना लगा सकी है, जिससे आयोग को मात्र 3,16,750/- (तीन लाख सोलह हज़ार सात सौ पचास) रुपये की आमदनी हुई है। अब आप स्वयं सोचिए कि ऐसे में कोई सूचना अधिकारी किसी को सूचना क्यों दे…? और जब मॉडल स्टेट की हालत ये है तो बाकी राज्यों में इस अधिकार के हश्र का अंदाज़ा आप खुद लगा सकते हैं।


लालू के लालटेन युग के बाद बिहार की जनता में यह उम्मीद जगी थी कि शायद अब भ्रष्टाचार पर लगाम लग जाएगी, लेकिन सुशासन के दौर में भी भ्रष्टाचार बेलगाम बढ़ता ही जा रहा है। खैर, बिहार सुधर सकता है, गरीबी का पहाड़ समतल हो सकता है, पर शर्त है कि पुराना ढब बदला जाए, पर यहां के सरकारी अधिकारी ऐसा हरगिज़ नहीं होने देंगे।

Batla House encounter: Doubts refuse to die ...

The bad memories of the infamous Batla House encounter in Jamia Nagar, conducted after serial blasts in the capital on September 19 last year, refuse to fade away with time. The locals, politicians and academicians of university nearby Jamia Nagar still feel that the justice has not been done.
Teachers, students and civil right activists participated in the mashaal march (torchlight rally) on the eve of the encounter anniversary conducted by Jamia Teachers' Solidarity Group, an association of teachers of Jamia Millia Islamia formed after the encounter last year. They demanded independent judicial enquiry. Many compared it to the Ishrat Jahan's case in Gujarat, where judicial probe questioned the role of the police involved in the 2004 encounter.
Newly-elected MLA of the Okhla assembly, Asif Mohammad Khan, was also present on the occasion. He said that he has been raising the issue of independent enquiry and will continue to do so at all platforms.
There is no real progress in the encounter case yet. Those who have been arrested in this connection are still languishing in jail. A report by the National Human Right Commission (NHRC) has already given a clean chit to the operation and remarked that "there is no need for further enquiry". Accordingly, the Delhi High Court denied any further enquiry into the matter.
But the controversy refuses to die down. Act Now for Harmony and Democracy (ANHAD), an NGO led by Shabnam Hashmi, has filed a petition in the Supreme Court against the HC order requesting for judicial enquiry. "People raise questions because they have doubts. If the government and the police have nothing to hide, why are they shying away from an enquiry?" questioned Afroz Alam Sahil. He had sought information under the Right to Information (RTI) Act from several bodies including the Delhi Police, the NHRC and the hospital where the post-mortem of the deceased were conducted. He has been "denied" information in a "clear mockery of the RTI," he said.
A protest march, led by Magsaysay award winner, Sandeep Pandey, and activists of Peoples Union for Civil Liberties (PUCL) and Sanjarpur Sangharsh Seva Samiti, was organised in Azamgarh. Atif Amin and Mohd Sajid, killed in the Batla House encounter, were Azamgarh. The participants in the march reiterated their demand for an independent judicial enquiry.

The Batla House Encounter: Unanswered Questions.

The 19th of September this year was special for the people of the Batla House area and the university of Jamia Millia Islamia in New Delhi. It was the first anniversary of the infamous Batla House encounter which took place a year ago in the L-18 building of the area. Delhi Police, in the encounter, shot down two Jamia students, Atif and Sajid in cold blood, claiming they were terrorists. Superintendent of Police (SP) Mr. Mohan Chand Sharma lost his life in the encounter. But this encounter left many unanswered questions which left a deep suspicion in the minds of many people.
As one year has passed by, we got to see that people gave mixed reactions to this incident. In Batla House, people were angry and cried foul over the actions of the police and the government. While many others mourned the day for the martyrdom of Mr. Mohan Chand Sharma. Posters praising the bravery of the late SP and the importance of the encounter could be seen in many areas of the city. The Jamia Teachers’ Solidarity Association and the All India Students Association (AISA) came out with a torchlight rally in Batla House on 18th September to mark the eve of the encounter.
The most noticeable thing about the encounter was the trail of unanswered questions it has left behind. The clean chit given to the Delhi Police by the National Human Rights Commission (NHRC) has further left people fuming. And even the court has not given any definitive judgement to the case. In this scenario, are worth to be noted two RTIs (Right to Information) appeals which were filed last month. Afroz Alam Sahil, an RTI activist, filed two RTIs on the 12th of August seeking information from the NHRC and the authority of Jamia. But the replies to these two RTIs have not been given till date. And it is to be noted here that it is mandatory to give a reply to an RTI in a period of one month even if the reply is no.
One RTI had been directed to the Jamia authority about their stand on the matter of the students who had been arrested in this case. Last year, the ex-Vice-Chancellor of Jamia, Prof. Mushirul Hassan had talked of giving legal aid to the ones who had been arrested in this case. For this purpose a sum of money was collected by the students. But till date there has been no report of any legal aid given by the university. The RTI had questions relating to the number of students arrested in connection to this case and also if Jamia had taken any action against them. It also asked questions relating to the current status of the legal aid that Prof. Hassan had talked of giving. It asked questions like how much money had been spent on it and if not, then what was delaying it?
The second RTI was directed towards the NHRC. Ever since the NHRC had given the clean chit to Delhi Police in the case, its style and methods of workings have been questioned by people. This RTI asked questions which ranged from the Commission’s working patterns in investigating this case to the loopholes that had crept out in the results of their investigations. It had questions as whether the NHRC met witnesses and families of the victims and also whether they examine they examined the place of encounter. It seeked names of the witnesses that were talked to and also the names and designations of those who were members of the team investigating the case. Here again, two very important questions were raised. Firstly, there was no magistrate enquiry in the Batla House Encounter case even though this is mentioned in the NHRC guidelines. Secondly, Mr. Mohan Chand Sharma had reportedly got medical aid in five minutes after he was shot. Then how did he die of excessive bleeding?
Questions like these raise serious doubts about the authenticity of the encounter. Residents of Batla House and the Jamia fraternity swear by the fact that Atif and Sajid were innocent students who became victims of the conspiracy of the police and the government. But what really was the scene can only be speculated till some new findings come out. The questions that are asked are not just relevant in the matter of a cover-up by the police. It is more about the way the minorities in India are treated by the establishment to hide its own failures. It is also about the trust that the students of a university expect from the authorities once they are promised.

NHRC sitting on RTI petition seeking details about its Batla encounter probe

New Delhi: It’s about one and half months since an application under Right to Information Act was filed with the National Human Rights Commission seeking explanations about the method and procedures of its enquiry into the Batla House encounter, but the apex constitutional body on human rights is yet to respond.
The NHRC in its report on the encounter submitted to the Delhi High Court on August 4 had given a clean chit to the Delhi Police in the September 19, 2008 encounter at House No. L-18 in the Batla House locality of Delhi’s Jamia Nagar. Two youths of Azamgarh, suspected to be terrorists, and Inspector MC Sharma were killed in the shootout. Neighbors, human and civil rights groups and parents of the slain youths said the encounter was staged and demanded a judicial probe. The demand was rejected by the government. However, at the order of the High Court, NHRC conducted a probe in which it declared that the encounter was genuine and the police opened fire in self defence.
The NHRC was alleged to have prepared the report without bothering to visit the spot, taking views of the neighbors, human rights activists, parents and even the accused the police claimed to have arrested from the flat.
The RTI application filed with the NHRC on August 12 sought to know: if in the process of the enquiry the commission talked to the family of Inspector MC Sharma, Atif and Sajid – the two Azamgarh youths killed in the encounter. The applicant also wanted to know if taking views of the petitioners and respondents and their witnesses is part of the process of its enquiry or not.
Does the commission visit site of encounter while probing it? If yes, then when did the commission visit the spot of Batla House encounter (date and time) and who did they talk to? asked the petitioner.
The petitioner has also sought to know from the commission as to why the commission did not order for a magisterial probe in Batla House encounter when its guidelines ask the commission to do so in every encounter.
Talking to TwoCircles.net on September 19, the day of the first anniversary of the Batla House encounter, RTI activist and petitioner of this application Afroz Alam Sahil said that the mandatory 30 days to respond to the application have ended and the commission is yet to respond his application. Sahil has sought information on 13 points related to the NHRC probe into the Batla encounter.

हे इन्द्र देव पानी बिन पड़ल बा अकाल...

“घनर, घनर, घनर, घनर के घिर आए बदरा... घन गनघोर कार छाए बदरा... चमक-चमक देखो बिजलियां चमके... मन धड़काए बदरवां... मन धड़काए बदरवां... काले मेघा-काले मेघा पानी तो बरसाओ, बिजली की बौछार नहीं, बूंदो के बाण चलाओ...”

लगान फिल्म का यह गीत किसे याद नहीं होगा। खैर ये दृश्य अंग्रेज़ों के वक़्त के चम्पानेर के उपर दर्शाए गए थे, लेकिन बिहार के चम्पारण का दृश्य तो कुछ और ही है। यहां के बादल तो आवारा हो गए हैं। आते हैं और शक्ल दिखाकर चले जाते हैं। आधा सावन बीत चला है, पर लोग पानी के एक-एक कतरा को तरस रहे हैं। पशु-पक्षियों में भी पानी के लिए हाहाकार मचा हुआ है, और पानी की तलाश में भटक-भटक कर दम तोड़ रहे हैं।

आकाश में बादल मंडराते ही बच्चे खेल छोड़कर कह उठते हैं- ‘एक मुट्ठी सरसो, पीट-पीट बरसो’ पर इन मासूमों की आरज़ू-मिन्नत भी काम नहीं आ रही है। थरुहट इलाक़े में भगवान शंकर को ग्रामीणों ने हज़ारों बाल्टी पानी से नहलाया। (यहां ऐसी मान्यता है कि यदि शिवलिंग को घंटों पानी से नहलाया जाता रहा तो बारिश होने की संभावना बढ़ जाती है।) यही नहीं, यहां महिलाएं रात्रि में पुरुष का वेश धारण कर एक दूसरे पर कीचड़ और पानी फेंक रही हैं। (बारिश के लिए यहां यह टोटका सर्वाधिक प्रचलित है।) लेकिन रुठी बरखा रानी मानने को कतई तैयार नहीं है।

यहां के किसानों की आंखें आकाश को निहारते-निहारते पथरा चुकी हैं। ऐसे में अब पाताल पर निगाहें हैं। शायद वहीं से बदहाल खेतों की प्यास बुझे। पर, क्या करें…? बरखा रानी के साथ-साथ धरती मैया भी नाराज़ हैं। समतल खेतों की कौन कहे, सालों भर पानी से लबालब रहने वाले पश्चिम चम्पारण के योगापट्टी की प्रसिद्ध लखनी चंवर की तल में भी फटी दरारें नज़र आ रही हैं। शायद ऐसा पहली बार हुआ है।

कभी गंडक की कहर से हज़ारो-हज़ार हेक्टेयर में लगी फसलें बर्बाद होती रही हैं। वहीं इस वर्ष पटवन के अभाव में फिर से किसानों पर प्रकृति कहर बरपा रही है। लगभग एक माह से वर्षा नहीं होने के कारण धान के बिचड़े पीले पड़ कर सुखने लगे हैं। मकई, अरहर व सब्जियों का भी यही हाल है। संपन्न किसान 100 रुपये प्रति घंटा पंप सेट का भाड़ा देकर खेती करने का प्रयास कर रहे हैं, (क्योंकि नहरों से सिंचाई के स्त्रोत समाप्त हो चुके हैं, और वैसे भी 1986 की प्रलयंकारी बाढ़ में ध्वस्त तिरहुत दोन व त्रिवेणी नहर अभी भी अपनी मरम्मती की राह देख रहे हैं।) परंतु प्रचंड धूप इनकी इन कोशिशों पर पानी फेरने में कोई कसर नहीं छोड़ रही है। क्या करें अब तो रुठे इन्द्र देवता को मनाने के लिए तरह-तरह के टोटके, हवन, भजन-कीर्तन, पूजा-पाठ और दुआ व नमाज़ का ही सहारा है। और फिर उस दिन का इंतज़ार जब सब झूम-झूम कर गाएंगे-
“हरियाला सावन ढोल बजाता आया, धिन-तक-तक मन का मोर नचाता आया। मिट्टी में जान जगाता आया, धरती पहनेगी हरी चुनरिया बन के दुल्हनिया... हरियाला सावन ढोल बजाता आया...”

AIIMS delays Delhi Encounter Autopsy Report

Persistent efforts of civil rights activist, Afroz Alam Sahil, appear to have paid dividend in Delhi’s Batla House encounter case. Following directives of the Central Information Commission, the appellate authority of All India Institute of Medical Sciences (AIIMS) has asked the Central Public Information Officer (CPIO) of Jai Prakash Narayan Apex Trauma Centre (JPNATC) to issue Afroz the autopsy reports of deceased in the encounter.
Afroz had sought information under Right to Information Act (RTI) Act. But, he was repeatedly denied, after which he had approached the Information Commission. Afroz is not happy though. “AIIMS was directed to furnish information by June 10. But, letter to the JPNAPTC was written after 20 days. Till date, I have not received any report,” he said. Incidentally, Afroz is a student of Jamia Millia Islamia, a central university in Delhi.
Information commissioner, Anupama Dixit, after hearing response from AIIMS authority on June 9 was not satisfied with the argument that ‘disclosure of information at this stage would impede the process of investigation’. It upheld the argument put forward by the appellant that ‘the post-mortem reports are now irrevocable’.
The commission, however, allowed the CPIO to apply Section 10 (1) of the RTI Act (2005) to sever those parts of the reports which are exempted from disclosure. This has been done keeping in view the confidentiality of names of the doctors involved, as the case is still pending in the court.
Accordingly, Dr YK Gupta, appellate authority of AIIMS, wrote a letter to the CPIO of JPNATC, Prof MC Misra on June 29, a copy of which is available with this reporter. In the letter, Gupta has directed the CPIO to ‘comply with the orders issued by the Central Information Commission’.
Batla House is a colony in the vicinity of Jamia University, comprising predominantly of Muslims. After serial blasts in Delhi on September 13, 2008 Batla House locality was on the radar of investigation agencies. Within a week, on September 19 two alleged Indian Mujahideen terrorists were killed in an armed police operation in now famous house number L-18 of the colony. Inspector MC Sharma succumbed to injuries in the hospital later that day. In days that followed some more alleged conspirators were arrested. Contradictory statements of the police and refusal of the government to order a judicial inquiry have raised doubts on the authenticity of the encounter.
A report released by Jamia Teachers Solidarity Group (JTSG) has brought to notice many loopholes in the operation and an alleged cover-up later.
Prosecution has consistently denied providing any detail to the defense or making them public, citing clause 8 (1) (h) of the RTI Act that gives the privilege of not supplying information if ‘disclosure may impede the process of investigation’.
Eminent lawyer, Prashant Bhushan, who is also the counsel of one of the accused, Zia ur Rehman, had filed a similar petition to the Delhi Police for copies of FIR and autopsy reports. He, too, was denied. Like Afroz, he had also approached the Information Commission.
The bench comprising Chief Information Commissioner, Wajahat Habibullah, and Information Commissioner, Shailesh Gandhi heard the police version on March 9, 2009. Not convinced, it had asked the public information officer of Delhi Police to provide copies of documents to the defense within 10 days, after applying severability clause.
Delhi High Court had, however, stayed the order. Prashant Bhushan is bitter as he pointed out that it is against the National Human Rights Commission’s guidelines. “It shows that they are trying to hide something,” he told when contacted. He further added, “It’s very difficult for me and other counsels to proceed without exactly knowing what happened on the day.”
Meanwhile, another turn of events in Dehradun, the capital of north Indian state of Uttarakhand, has given a new twist to the case. Last week an MBA student Ranbir Singh was allegedly killed by the state police. After huge uproar the government has agreed for inquiry. JTSG has issued a statement alleging double standards on part of the government and political parties. While everyone in unison supported family's demand for inquiry in the Dehradun case, chief minister of Delhi, Sheila Dixit had said on record that such an investigation would demoralize the police. JTSG reiterated on its demand for judicial inquiry.
The next hearing in the Batla House case has been fixed for July 20.

It upheld the argument put forward by the appellant that 'the post-mortem reports are now irrevocable'.
It, however, allowed the CPIO to apply Section 10 (1) of the RTI Act to sever those parts of the reports which are exempted from disclosure. This has been done keeping in view the confidentiality of the names of doctors involved, as the case is still pending in the court.
Accordingly, Dr Gupta has written a letter to the CPIO of JPNATC dated June 29, a copy of which is available with Hardnews. In the letter, Gupta has directed the CPIO to 'comply with the orders issued by the Central Information Commission'.
Locals believe that the Batla House Encounter, which occurred on September 19, 2008 was 'fake'. Two alleged Indian Mujahideen terrorists were killed in the operation and Inspector MC Sharma succumbed to injuries in the hospital later that day. Contradicting statements of the police and refusal of the government to order a judicial enquiry has raised doubts on the authenticity of the encounter.
A report released by the Jamia Teachers Solidarity Group had brought to notice many loopholes in the operation and an alleged cover-up later.
Prosecution has consistently denied supplying any information to the defence or making them public, citing clause 8 (1) (h) that says: disclosure may impede the process of investigation.
Eminent lawyer, Prashant Bhushan, who is also the counsel of one of the accused, Ziaur Rehman, had filed a similar petition to the Delhi Police for copies of FIR and autopsy reports. He, too, was denied. Like Afroz, he also had approached the Information Commission.
After hearing the police version, the bench comprising chief information commissioner, Wajahat Habibullah, and information commissioner, Shailesh Gandhi, had ordered the public information officer of Delhi Police to provide copies of documents after applying severability clause within 10 days on March 9.
Delhi High Court had, however, stayed the order. Prashant Bhushan is bitter as he pointed out that it's against the National Human Rights Commission's guidelines. "It shows that they are trying to hide something," he told Hardnews. He further added, "It's very difficult for me and other counsels to proceed without exactly knowing what happened on the day."
The next hearing has been fixed for July 20.

सूचना आयोग के आदेश के बावजूद एम्स से सूचनाएं नहीं

केन्द्रीय सूचना आयोग के आदेश के बावजूद एम्स ने बटला हाउस एनकाउंटर में मारे गए कथित आतंकी युवकों की पोस्टमॉर्टम रिपोर्ट करीब एक माह बाद भी सामने आने नहीं दी है। यह रिपोर्ट अब तक सामने न आने से इस मुठभेड़ पर सवालिया निशान लगता रहा है। यह रिपोर्ट हासिल करने के लिए जामिया के छात्र अफरोज आलिम साहिल काफी समय से जद्दोजहद करते रहे हैं।
अफरोज के मुताबिक, उन्होंने सूचना के अधिकार कानून के तहत दिल्ली पुलिस और एम्स से यह रिपोर्ट हासिल करने की कोशिश की। लेकिन एम्स ने इस आधार पर यह रिपोर्ट देने से मना कर दिया कि ‘यह सूचना मेडिको लीगल रिकॉर्ड्स से संबंधित है’ और ‘इस तरह की सूचना संबंधित अधिकारी, संस्थान या कोर्ट के आदेशानुसार संबंधित लोगों के लिए ही दी जती है।’ दिल्ली पुलिस ने भी इसकी सूचना देने से मना कर दिया।
अफरोज ने बताया कि इसके बाद उन्होंने आयोग का दरवाज खटखटाया। आयोग ने 9 जून को दिए आदेश में एम्स को यह रिपोर्ट देने को कहा। आयोग ने अपने आदेश में यह भी कहा कि अफरोज द्वारा मांगी गई दो सूचनाएं नहीं दी जा सकतीं: पहली, मुठोड़ में मारे गए लोग एम्स में कब लाए गए और दूसरी, अस्पताल ने लाशें पुलिस के हवाले कीं या मारे गए लोगों के परिजनों के। लेकिन आयोग ने पोस्टमार्टम रिपोर्ट के साथ दो अन्य सूचनाएं भी मुहैया कराने को कहा: पहली, पोस्टमार्टम करने वाले डॉक्टरों के नाम और पद तथा दूसरी, रिपोर्ट किसने तैयार की?
अफरोज का कहना है कि एम्स के फार्माकोलॉजी के प्रमुख डॉ. वाई.के. गुप्ता का एम्स के ट्रॉमा सेंटर के प्रमुख एम.सी. मिश्र के नाम 29 जून को लिखा पत्र तो उन्हें मिला है जिसमें आयोग के आदेश का हवाला देते हुए ये सूचनाएं देने को कहा गया है लेकिन सूचनाएं अब तक नहीं मिल सकी हैं।

Background
1. The Applicant filed an RTI application dt.25.9.08 with the CPIO, AIIMS. He requested for information against 5 points regarding the people who died in the encounter that took place on 19 September, 2008 at Batla House, Jamia Nagar including: 1)when the bodies of the victims of the encounter were brought to the hospital; 2)the names of doctors who conducted the postmortems along with their designations ;3)who prepared the postmortem report; 4)certified copies of individual postmortem reports and 5) whether the bodies were handed over to the relatives or to the police after the postmortem. The CPIO replied on 13.10.08 denying the information u/s 8(1) (b) and 8(1)(h). Not satisfied with the reply, the Applicant filed an appeal dt.15.10.08 with the Appellate Authority reiterating his request for the information. The Appellate authority, after taking the advice of the CPIO, replied on 4.3.09 upholding the decision of the CPIO. Aggrieved with the reply, the Applicant filed a second appeal dt.28.5.09 before the CIC.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the hearing for June 9, 2009.

Decision
5. On review of the RTI request by the Commission it was agreed by the Respondents that information sought against points 1 and 5 would be

provided since the information does not fall under exemptions 8(1)(b) and (h) which were the reasons given by the CPIO to withhold the information; since they are neither confidential nor will disclosure of information impede the process of investigation. The Commission denies disclosure against points 2 and 3 under section 8(1)(g) and 8(1)(b) of the RTI Act since disclosure of information about Doctors who have conducted the postmortem may endanger the life and physical safety of these individuals besides exposing them to undue pressure and acting as a major impediment in the process of investigation.

With regard to Point 4, the Respondent submitted that in a similar case wherein the RTI request was filed before the Delhi Police by an Applicant, the Applicant sought an interim order dated 31.3.09 suspending the operation of the decision CIC/WB/A/2009/0023 dated 9.3.09 by the Central Information Commission, whereby the information sought by the Applicant vis-à-vis postmortem report and the FIR in connection with the encounter in Jamia Nagar were directed to be granted, subject to favourable conditions under Section 10(i). The Respondent, also contended during the hearing that the CIC, in its decision mentioned above, had itself admitted that ‘part of the information held in the mentioned documents merits exemption u/s 8(1)(h) and (g)’ and that the Delhi High Court had suspended operation of the CIC order on the ground that the Commission had ordered disclosure without being alive to the investigative process.
7. The Commission heard the submissions put forward by the Respondents for denying disclosure of postmortem reports and noted that apart from their argument that the earlier CIC decision No. CIC/WB/A/2009/0023 dated 9.3.09 on disclosure of postmortem reports has been stopped from operation, were not able to explain how the disclosure of information at this stage would impede the process of investigation.
7. The Commission also noted the argument put forth by the Appellant in the earlier case, as given in the CIC Order, quoted hereinunder :
"the FIR in this particular case has already been exposed to much publicity and the post mortem reports are now irrevocable. Their
disclosure in no way could impede the process of investigation or prosecution"
and in the light of the abovementioned CIC Order, directs the CPIO to provide the postmortem reports after applying Section 10(1) of the RTI Act to severe those parts of the reports which are exempted from disclosure under Section 8(1), along with information against points 1 and 5, by 10 June, 2009.
8. The Commission accordingly disposes of the appeal.

Release Batla encounter victims’ autopsy reports: CIC to AIIMS

New Delhi: The Central Information Commission (CIC) has directed the All India Institute of Medical Sciences (AIIMS) to hand autopsy reports of the Batla House encounter victims over to an RTI applicant. The victims include two Delhi serial blasts suspects and a police officer.
In its June 9 hearing on the application of Afroz Alam Sahil, a mass communication student of Jamia Millia Islamia, the CIC decided to ask India’s premier hospital AIIMS – where the autopsy was conducted on blasts suspects Mohammed Atif Amin and Sajid, and Delhi Police Inspector Mohan Chand Sharma – to release the autopsy reports and provide relevant information sought by the RTI applicant Sahil. In the encounter that took place at House No. L-18 on September 19, 2008 the two suspects hailing from Azamgarh were killed and Inspector Sharma sustained bullet injuries which he later succumbed to.
A few months back the Delhi High Court had stayed a similar CIC order on the ground that it will hamper investigation.
“I had sought to know how many people from the L-18 on that day were brought to the AIIMS for autopsy. My second query was: who were the bodies of the suspected terrorists handed over – their family or police. I had also sought the autopsy report,” said Sahil talking to TwoCircles.net. he was the first to move the Delhi Police and AIIMS seeking FIR copy and autopsy report. He filed his first application on September 25, 2008, which was not answered by the police and rejected by the AIIMS.
Following the recent CIC order Sahil has got a letter from AIIMS on July 2 wherein the authority of the hospital has ordered its Public Information Officer to provide the applicant with the autopsy report and information regarding his queries.
“I also wanted to know as to who conducted the autopsy and who prepared the report. But this information was denied to me both by the CIC and the hospitals citing security reasons,” adds Sahil.
RTI activist Sahil has been working on social and political issues for some years. He spends his own pocket money on RTI processes. Very recently he rejected award nomination proposals from an NGO. “I am not doing all these for awards,” says humble Sahil in early twenties.

पोस्टमार्टम रिपोर्ट देने के निर्देश

बटला हाउस मुठभेड़ मामले में केंद्रीय सूचना आयोग [सीआईसी] ने एम्स प्रशासन को याचिकाकर्ता को घटना में मारे गए लोगों की पोस्टमार्टम रिपोर्ट देने के निर्देश दिए हैं। इस पर एम्स प्रशासन ने याचिकाकर्ता को रिपोर्ट देने का आदेश जारी किया है।
गौरतलब है कि याचिकाकर्ता अफरोज आलम साहिल ने मुठभेड़ में शहीद हुए इंस्पेक्टर एमसी शर्मा और मारे गए दोनों आतंकी आतिफ अमीन व मुहम्मद शाजिद का पोस्टमार्टम करने वाले डाक्टरों के नाम का भी खुलासा करने की मांग की थी। जिसे सीआईसी ने यह कहते हुए ठुकरा दिया कि इसका खुलासा किए जाने से डाक्टरों की जान को खतरा हो सकता है।

Release Batla victims’ autopsy reports: CIC

Nearly three months after the Delhi High Court put a prohibition on making public the postmortem reports of the people killed in the Batla House encounter last year, the Central Information Commission (CIC) has directed the All India Institute of Medical Sciences (AIIMS) to hand them over to an RTI applicant.
The CIC’s directive, clearly distinct from the court’s views, was based on the fact that AIIMS could not explain how the disclosure could hinder the course of investigations in the case anymore.
All that the AIIMS could put forth in their argument was that the earlier CIC decision has been stayed by the High Court, said the Information Commissioner Annapurna Dixit, allowing the plea of Afroz Alam Sahil.
The Special Cell’s encounter at L-18, Batla House, in South Delhi on September 19, had left two serial blasts suspects — Mohammed Atif Amin and Sajid — and Inspector Mohan Chand Sharma dead.
Acting on a petition by well-known lawyer Prashant Bhushan, the CIC had on March 9 directed the Delhi Police to hand over within 10 days the postmortem reports of those gunned down in the encounter, including that of slain officer Sharma.
The police, however, challenged the order in the High Court, which stayed the CIC’s order after agreeing with the argument that a disclosure at the stage when they were yet to arrest a few absconding accused and collect other evidence, could dent their efforts in the cases related to the blasts that shook Delhi on September 13 last year.
In a separate petition filed last September soon after the encounter, Sahil had requested the CIC to direct the AIIMS Trauma Centre, where the postmortems were conducted, to give him the reports along with some other related information.
As the AIIMS refused to part with the information citing the confidentiality clause of the RTI Act, Sahil filed appeals against the same with the CIC in October.
Refusing to buy their arguments, Information Commissioner, Dixit, also cited a portion of the earlier decision of the CIC in the matter that read, “The FIR in this particular case has already been exposed to much publicity and the postmortem reports are now irrevocable. Their disclosure could, in no way, impede the process of investigation or prosecution.”
Lending credence to these observations, the CIC then ordered the AIIMS to hand over the postmortem reports to Sahil. The directive came with the sole rider that only those parts could be kept away from the applicant which are allowed to be exempted under the confidentiality clause of the RTI Act.
Meanwhile, the trial court, hearing the Batla House encounter case, declared Ariz Khan and Shahzad Ahmed proclaimed offenders on Friday as they continue to remain absconding.
The two had allegedly managed to escape after the encounter.

The truth of Bihar's development.

In Bihar, the last phase of the 15th Lok Sabha elections is underway. For the first time, issues of development are prominent. During election campaigns, Chief Minister Nitish Kumar has projected himself as the harbinger of development. And he also rapped the Centre on this issue saying the Central UPA Government is not giving the right attention to Bihar. And UPA leaders are alleging that Bihar’s development is due to the Centre’s money. But Nitish dismisses them as liars.
But the Bihar state government has some papers are stating something else about its achievements. But a reply to an RTI has shown that the Central government has helped the Nitish government more than the erstwhile Lalu-Rabri government in Bihar. Also the information states that international agencies are helping the state government on a big level but still the money is not fully being utilised by the state government.
Under the Right to Information (RTI) Act, the information got from the state government has falsified the campaigning claims of the state government leaders. Statistics show that during the NDA government, between 2003-04, the Bihar government got Rs 1617.62 crores from the Centre. But after the change in power at the Centre, the Centre began to pay double the amount to the state government. In the first financial year 2004-05, the Centre gave an amount of Rs 2831.83 crores to the Bihar state government.
After this, the power changed on the state level, and Mr Nitish Kumar became the Chief Minister of Bihar. This government formed by BJP support, got Rs 3332.72 crores from the Central government during the year 2005-06. During the next financial year, in 2006-07, the amount was increased to Rs 5247.10 crores. The statistics after this are not available by the state government, but officials believe that the Centre has increased help nonetheless. So if we talk of statistics given by the state government, then we find that the present state government has got Rs 8579.83 crores from the Centre, while the last state government got Rs 7984.56 crores from the Centre in the last five years.
There is another element that questions the state government’s activities on development in Bihar. Statistics reveal that the government is not keen on spending the money it receives.
The state government, during the year 2006-07, has got Rs 92.92 lakh rupees from the World Bank, but only Rs 60 lakh rupees were spent. In the next financial year 2007-08, Bihar government got Rs 464.15 crores from the World Bank. But documents reveal that the state government spent only Rs 6.13 crores out of this. Not only this, but there is a ward in Bihar which states in written that during Nitish’s tenure there was no development work there.
The documents by the state government also reveal that the state government has been more intent in promotional activities than in developmental activities. During the year 2005-08, Bihar’s Information & Public Relations Department has issued 28,000 different advertisements and for this purpose, the department has spent Rs 19.56 crores. But it is not only this. The developmental activities for which crores of rupees have been spent is not known to educated people, leave alone the others. For example, to help the indisposed of Bihar, a call centre “solution” was started with the very motive. The government officials however turned out to be the healthiest out of this initiative. And now it is only to see when they will be afflicted by Diabetes.
Anyways, after cutting the harvests and staying in air-conditioned tents and looking out to the conditions of the villages, while riding high on the chariots of his “Nyaya Yatra and Vikas Yatra”, people really expect the Chief Minister to honestly speak in his speeches. Honesty, the word that changed the government in Bihar. The word on which the present government came to power in Bihar.

चुनाव प्रचार के दौरान बिहार के मुख्यमंत्री नीतीश कुमार ने ख़ुद को राज्य का विकास का पहरुआ बताया है और साथ ही केंद्र को कटघरे में खड़ा किया है, यह कहते हुए कि विकास के लिए बिहार जैसे ग़रीब राज्य को केंद्र पैसा ही नहीं दे रहा.
लेकिन राज्य सरकार के ही काग़ज़ चुनावी मौसम की इस राजनीतिक भाषा की कुछ और चुगली करते नज़र आते हैं.
बिहार सरकार से सूचना का अधिकार क़ानून के तहत मिली जानकारी से यह स्पष्ट दिखाई देता है कि वर्तमान राज्य सरकार को पिछली राज्य सरकार की तुलना में लगभग दोगुना पैसा केंद्र सरकार से मिला है.
इतना ही नहीं, जानकारी यह भी दिखाती है कि पहली बार अंतरराष्ट्रीय एजेंसियों से राज्य को बड़ी मदद मिलनी शुरू हुई है लेकिन विकास के लिए लिया जा रहा पैसा इस्तेमाल ही नहीं हो रहा है.
सूचना का अधिकार क़ानून के तहत युवा कार्यकर्ता अफ़रोज़ आलम साहिल ने राज्य सरकार से जानकारी मांगी कि पिछले आठ वर्षों में केंद्र सरकार से राज्य सरकार को कितना कितना पैसा मिला है. यह भी पूछा गया कि अंतरराष्ट्रीय एजेंसियों से कितना अनुदान राज्य सरकार को प्राप्त हुआ है.
राज्य सरकार से लंबे इंतज़ार के बाद जो जानकारी मिली, वो राज्य सरकार के नेताओं की चुनावी प्रचार की भाषा को ग़लत साबित करती नज़र आती है.
केंद्र से मिली राशि
आंकड़े बताते हैं कि राष्ट्रीय जनतांत्रिक गठबंधन (राजग) सरकार के कार्यकाल के दौरान वर्ष 2003-04 में राज्य सरकार को केंद्र से 1617.62 करोड़ रूपए मिले थे. पर केंद्र में सरकार बदलने के बाद यूपीए ने राज्य सरकार को लगभग दोगुना पैसा देना शुरू किया.
पहले ही वित्तीय वर्ष यानी वर्ष 2004-05 में केंद्र ने राज्य सरकार को 2831.82 करोड़ रूपए की राशि उपलब्ध कराई.
इसके बाद राज्य में सत्ता परिवर्तन हुआ और नीतीश कुमार मुख्यमंत्री की कुर्सी पर बैठे. भारतीय जनता पार्टी (भाजपा) समर्थन से बनी इस राज्य सरकार को वर्ष 2005-06 में 3332.72 करोड़ रूपए केंद्र सरकार से मिले.
इसके अगले वित्तीय वर्ष में यानी वर्ष 2006-07 में यह राशि बढ़ाकर 5247.10 करोड़ कर दी गई. इसके बाद के आंकड़े राज्य सरकार उपलब्ध नहीं करा पाई है पर अधिकारी मानते हैं कि केंद्र से मदद बढ़ी ही है.
राज्य सरकार के उप मुख्यमंत्री सुशील मोदी ने बीबीसी को इस बारे में बताया कि केंद्र का रवैया सौतेला ही रहा है. पिछली सरकार से वर्तमान सरकार की तुलना के आधार पर राज्य के लिए ज़रूरी राशि की बात नहीं करनी चाहिए.
पर चुनाव के दौरान लोगों से यह कहना कि केंद्र ने राज्य सरकार को पैसा नहीं दिया, कहाँ तक सही है.
इसपर सुशील मोदी कहते हैं, "पिछली सरकार विकास के नाम पर कुछ नहीं करती थी. जो पैसा नाममात्र के लिए आता था, उसे भी राज्य सरकार ख़र्च नहीं कर पाती थी. अब विकास का काम शुरू हुआ है तो उसके लिए पैसा चाहिए पर जितना चाहिए, उतना केंद्र से नहीं मिल रहा है."
विश्व बैंक की मदद
लेकिन एक तथ्य और है जो राज्य सरकार के विकास कार्यों पर होने वाले ख़र्च पर सवाल उठा देता है. राज्य सरकार से मिले दस्तावेज़ों में यह जानकारी भी मिली है कि विश्व बैंक से कितना पैसा राज्य सरकार को मिल रहा है और उसमें से कितना ख़र्च हो रहा है.
सुशील मोदी गर्व के साथ बताते हैं कि उनके कार्यकाल के दौरान ही विश्वस्तरीय एजेंसियों में राज्य सरकार के प्रति विश्वास पैदा हुआ है और सहायता मिलनी शुरू हुई है. पर आंकड़े कहते हैं कि पैसा लेने में चुस्त सरकार, उसे ख़र्च करने में सुस्त है.
राज्य सरकार को वर्ष 2006-07 में विश्व बैंक से ग़रीबी उन्मूलन कार्यक्रम के लिए 92.92 लाख रूपए मिले पर ख़र्च हुए कुल 60 लाख रूपए. अगले वित्तीय वर्ष यानी 2007-08 में ग़रीबी उन्मूलन, लोक व्यय एवं वित्तीय प्रबंधन और बिहार विकास ऋण के लिए राज्य सरकार को 464 करोड़ रूपए मिले पर दस्तावेज़ बताते हैं कि राज्य सरकार ने इसमें से कुछ 6.13 करोड़ रूपए ही ख़र्च किए हैं.
इस बारे में उप मुख्यमंत्री सुशील मोदी अपने ही विभाग से मिली जानकारी को ग़लत बताते हैं और कहते हैं कि जितना पैसा मिल रहा है, उसका पूरा इस्तेमाल हो रहा है और ऐसा किसी साज़िश के तहत राज्य सरकार को बदनाम करने के लिए किया जा रहा है.
हक़ीक़त की चुगली
सुशील मोदी कहते हैं, "आपके पास जो भी आंकड़ा है वो ग़लत आँकड़ा है, पहली बात तो विश्व बैंक जो पैसा देता हैं, उनकी अपनी शर्तें हैं, पहले ये संस्थाएँ पैसा नहीं देती थी लेकिन मौजूदा सरकार की कोशश के बाद ऐसा हो सका. इसके लिए इस सरकार ने उन संस्थाओं के सामने अपनी साख बनाई उसके बाद ही ऐसा हो सका है."
मोदी इस मुद्दे पर केंद्र की ओर एक और हमला करते नज़र आते हैं. वो सवाल उठाते हैं बिहार सरकार के बाढ़ राहत के लिए पैदा हुए आर्थिक संकट का.
मोदी कहते हैं, "राज्य सरकार को केंद्र से केवल एक हज़ार करोड़ की मदद मिली थी. वो तत्काल ख़र्च हो गई. उसके बाद कोसी तटबंध और बाढ़ प्रभावित ज़िलों के लिए हमने केंद्र से 14 हज़ार करोड़ की मदद मांगी पर केंद्र राष्ट्रीय आपदा घोषित करने के बाद भी कोई मदद दे नहीं रही है. यह सौतेला व्यवहार नहीं है तो क्या है."
बाढ़ के मुद्दे पर केंद्र को घेर रही राज्य सरकार काग़ज़ों में सामने आते सच पर साफ़ कुछ नहीं बता पाती. जो बताती है, उसमें और कागज़ों में दर्ज सच में फ़र्क साफ़ है. पर राजनीति में लोगों के सामने सच कितना और किस रूप में आता है, इस बार का चुनाव प्रचार इसका एक सटीक उदाहरण तो है ही.
खेतों को कटवाकर ताने गए वातानुकूलित तंबुओं में ठहरकर गांव की हालत देखते और न्याय यात्रा और विकास यात्रा के रथों पर सवार राज्य के मुख्यमंत्री से शायद लोग भाषा में ईमानदारी की भी उम्मीद करते हैं. ईमानदारी, जिस शब्द से राज्य में सत्ता बदली है. जिस नारे पर वर्तमान सरकार सत्ता में आई है।

नीतिश सरकार की इमानदारी....

बिहार में 15वीं लोकसभा चुनाव का अंतिम दौर चल रहा है। पहली बार यहां विकास का मुद्दा हावी है। चुनाव प्रचार के दौरान मुख्यमंत्री नीतीश कुमार ने खुद को राज्य के विकास का पहरुआ बताया है और साथ ही केंद्र को कटघरे में खड़ा किया है, यह कहते हुए कि “केन्द्र की यूपीए सरकार बिहार को वाजिब हक नहीं दे रही है। उल्टे सूबे का विकास केन्द्र की राशि से होने की बात यूपीए के नेता कह रहे हैं। उनकी यह कथनी सरासर झूठ है।”

पर राज्य सरकार के ही कागज़ चुनावी मौसम की इस राजनीतिक भाषा की कुछ और चुगली करते नज़र आ रहे हैं। बिहार सरकार से सूचना का अधिकार अधिनियम के तहत मिली जानकारी के ज़रिए यह साफ़ दिखाई देता है कि केन्द्र सरकार ने गत दो वर्षों में बिहार के नीतीश सरकार को जितना मदद किया है, उतना लालू-राबड़ी सरकार को 6 वर्षों में भी नहीं। इतना ही नहीं, जानकारी यह भी दिखाती है कि पहली बार अंतरराष्ट्रीय एजेंसियों से राज्य को बड़ी मदद मिलनी शुरू हुई है पर विकास के लिए लिया जा रहा पैसा इस्तेमाल ही नहीं हो रहा है।

सूचना का अधिकार क़ानून के तहत राज्य सरकार से लंबे इंतज़ार के बाद जो जानकारी मिली है, वो राज्य सरकार के नेताओं की चुनावी प्रचार की भाषा को ग़लत साबित करती नज़र आ रही है।

आंकड़े बताते हैं कि एनडीए सरकार के कार्यकाल के दौरान वर्ष 2003-04 में राज्य सरकार को केंद्र से 1617.62 करोड़ रूपए मिले थे। पर केंद्र में सरकार बदलने के बाद यूपीए ने राज्य सरकार को लगभग दोगुना पैसा देना शुरू किया। पहले ही वित्तीय वर्ष यानी वर्ष 2004-05 में केंद्र ने राज्य सरकार को 2831.83 करोड़ रूपए की राशि उपलब्ध कराई।

इसके बाद राज्य में सत्ता परिवर्तन हुआ और नीतीश कुमार मुख्यमंत्री की कुर्सी पर विराजमान हुए। भाजपा समर्थन से बनी इस राज्य सरकार को वर्ष 2005-06 में 3332.72 करोड़ रूपए केंद्र सरकार से मिले। इसके अगले वित्तीय वर्ष में यानी वर्ष 2006-07 में यह राशि बढ़ाकर 5247.10 करोड़ कर दी गई। इसके बाद के आंकड़े राज्य सरकार उपलब्ध नहीं करा पाई है पर अधिकारी मानते हैं कि केंद्र से मदद बढ़ी ही है। इस प्रकार राज्य सरकार से मिले आंकड़ों की बात करें तो यह बताती है कि वर्तमान राज्य सरकार को मात्र दो वित्तीय वर्ष में ही 8579.83 करोड़ मिले, जबकि पिछले राज्य सरकार को पांच वित्तीय वर्षों में कुल 7984.56 करोड़ ही प्राप्त हुए।

एक तथ्य और है जो राज्य सरकार के विकास कार्यों पर होने वाले खर्च पर सवाल उठा देता है। आंकड़े कहते हैं कि पैसा लेने में चुस्त सरकार, उसे खर्च करने में सुस्त है।

राज्य सरकार को वर्ष 2006-07 में विश्व बैंक से गरीबी उन्मूलन कार्यक्रम के लिए 92.92 लाख रूपए मिले पर खर्च हुए कुल 60 लाख रूपए। अगले वित्तीय वर्ष यानी 2007-08 में ग़रीबी उन्मूलन, लोक व्यय एवं वित्तीय प्रबंधन और बिहार विकास ऋण के लिए राज्य सरकार को 464.15 करोड़ रूपए मिले पर दस्तावेज़ बताते हैं कि राज्य सरकार ने इसमें से सिर्फ 6.13 करोड़ रूपए ही खर्च किए हैं। यही नहीं बिहार में एक ऐसा वार्ड भी है जो लिखित रुप में यह कह रहा है कि नीतीश के शासनकाल में विकास का कोई कार्य नहीं हुआ है।

राज्य सरकार से मिले कागज़ के टुकडे यह भी बताते हैं कि वर्तमान राज्य सरकार का काम पर कम और विज्ञापन पर ज़्यादा ध्यान रहा है। बिहार के सूचना एवं जन संपर्क विभाग द्वारा वर्ष 2005-08 के दौरान लगभग 28 हज़ार अलग-अलग कार्यों के विज्ञापन जारी किए गए और इस कार्य के लिए विभाग ने 19.56 करोड़ रुपये खर्च कर दिए। बात यहीं खत्म नहीं होती। जिन विकास कार्य के नाम पर करोड़ों खर्च किए गए हैं, उस विकास कार्य की जानकारी आम लोगों की कौन कहे, यहां के पढ़े-लिखे लोगों तक को नहीं है। जैसे बीमार बिहार के स्वस्थ करने की नियत से शुरु की गई कॉल सेंटर “समाधान” का उदाहरण ही आप देख लीजिए। खैर बिहार की जनता स्वस्थ हो न हो, कम से कम सरकारी अफसर तो इस कार्य से ज़रुर स्वस्थ हो गए हैं। यह अलग बात है कि बाद में कहीं वो डायबटीज़ के पेसेंट न है जाएं।

मौसम और चुनाव..

मौसम में बढ़ती गर्मी, सूखते बादल और हवाओं का बदलता रूख.... हर तरफ धूल-धक्कड़ और चलती लू के थपेड़े... और फिर प्रतिद्वंद्वियों की चुनौतियों के बीच चुनाव की बढ़ती सरगर्मी और चिलचिलाती धूप.... मौसम की इस बेरुखी ने नेता व जनता दोनों को बेहाल कर रखा है।
जी! चुनाव के इस मौसम में सूरज की तपिश अपने उफान पर है। इसने कई जगह चुनावी गर्मी को ठंडा करने की कोशिश भी की है। चुनाव का द्वितीय चरण भी सूरज की तपिश के कारण फीका ही रहा। अब अगले चरण में दिल्ली की बारी है। जहां चुनावी गर्मी से एक ओर नेता परेशान हैं, तो वहीं दूसरी ओर प्राकृतिक गर्मी ने आम लोगों का जीना दुभर कर दिया है।
ज़रा सोचिए! यह तो अप्रैल का ही महीना है, और पारा 40-42 के पार जा चुकी है। मई-जून की गर्मी तो अभी बाकी ही है। आगे हमारा क्या हाल होगा, यह उपर वाला ही जानता है।
आखिर यह गर्मी हो क्यों ना...? पेड़ों की अंधाधुंध कटाई जो जारी है। यदि आंकड़ों की बात करें तो दिल्ली में विभिन्न विकास कार्यो के नाम पर पिछले 5 सालों में लगभग 50 हज़ार पेड़ काट डाले गए। खैर यह आंकड़े तो सरकारी आंकड़े हैं, जिसे सूचना के अधिकार के तहत लेखक को दिल्ली सरकार के वन एवं वन्यप्राणी विभाग ने उपलब्ध कराया है। अवैध रुप से कटने वाले पेड़ों की संख्या तो लाखों में होगी। लेखक ने स्वयं महरौली के आर्कियोलॉजिकल पार्क में हो रही पेड़ों की अंधाधुंध कटाई को देखा है। जंगल के जंगल साफ कर दिए गए हैं। लेकिन इसकी खबर प्रशासन को नहीं है।
सूचना के अधिकार के माध्यम से मिले आंकड़ों के मुतबिक वर्ष 2004-05 में 16,552 पेड़, वर्ष 2005-06 में 10,692 पेड़, वर्ष 2006-07 में 5,627 पेड़, वर्ष 2007-08 में 10,460 पेड़ और वर्ष 2008-09 में 17 अप्रैल तक 2,321 पेड़ काटे गए हैं। यही नहीं, कॉमनवेल्थ गेम्स के नाम पर जनवरी 2008 से मार्च 2009 तक 2986 पेड़ काटे गए। वहीं दिल्ली मेट्रो के नाम पर 387 पेड़ों की बलि चढ़ाई गई।
हालांकि विभाग के मुताबिक इन पेड़ों को काटने के बाद पेड़ लगाए भी गए हैं। लेकिन इस बात में कितनी सच्चाई है, ये किसी से छिपा नहीं है। बहरहाल, विभाग के मुताबिक वर्ष 2004-05 में 93,755 पेड़, वर्ष 2005-06 में 3,815 पेड़, वर्ष 2006-07 में 22,723 पेड़ और वर्ष 2007-08 में 10,722 पेड़ लगाए गए हैं। इन में से 12889 पौधे दिल्ली मेट्रो कॉरपोरेशन के शामिल हैं, जिसे ग़ाज़ीपूर- हिंडन कट में लगाया गया है। और दिल्ली मेट्रो ने इस कार्य हेतु 14,92,068 रुपये (चौदह लाख बानवे हज़ार अड़सठ रुपये) खर्च किए। बाकी के पेड़ों को लगाने में कितना खर्च हुआ है, इसका ब्यौरा विभाग के पास मौजूद नहीं है।
बात यहीं खत्म नहीं होती। जहां दिल्ली सरकार के विभिन्न विभागें विज्ञापन के नाम पर करोड़ों खर्च कर देती हैं, वहीं दिल्ली सरकार के इस विभाग ने लोगों को पर्यावरण के संबंध में जागरुक करने हेतु पिछले 5 सालों में कोई विज्ञापन जारी नहीं किया है।
सबसे दिलचस्प बात यह है कि इस मसले पर तमाम राजनीतिक दल खामोश हैं। हालांकि इस बार कुछ राजनैतिक विचारधाराओं ने पहली बार जलवायु परिवर्तन के संकट को अपनी प्राथमिकताओं में शामिल किया है। भाजपा ने जलवायु परिवर्तन के नियंत्रण को समुचित महत्व देने का वायदा किया है, लेकिन हिन्दुत्व के शोर में यह मुद्दा भी नदारद हो गया है। दुखद बात तो यह है कि जो विचार और वायदे कांग्रेस, भाजपा, वामपंथी सहित कुछ दलों ने अपने घोषणा पत्रों में दर्ज किए हैं उन्हें मतदाता तक पहुंचाने की कोई जद्दोजहद नजर नहीं आई।जबकि यह घोर चिंता का विषय है कि मानव अस्तित्व की रक्षा के लिए पर्यावरण के बारे में राजनीतिक दलों को जितनी गंभीरता से सोचना चाहिए, उतनी गंभीरता से नहीं सोचा जा रहा है। शायद राजनीतिक दल यह भूल रहे हैं कि जब मानव का अस्तित्व बचेगा, तभी राजनीति भी हो सकती है अन्यथा वह भी संभव नहीं है।

वोट आपका, सरकार चंदा देने वालों की

80 के दशक में जब मैं बिलासपुर के साइंस कालेज में पढता था उस कालेज में छात्रसंघ के चुनाव नहीं होते थे । उस समय के मध्यप्रदेश शासन ने यह तय किया था कि जिसके सबसे अधिक मार्क्स आयेंगे वही छात्रनेता भी बन जायेगा ।
इस तरह हमारे ज़माने में कार्ल मार्क्स और राजनीति शास्त्र सिर्फ किताबों तक ही सीमित थे । हमें सिर्फ एक ही तरह के मार्क्स की चिंता करनी थी जो परीक्षाओं के बाद रिज़ल्ट में मिलता है ।
कारण दिया जाता था कि छात्रसंघ चुनावों में काफी वक्त ज़ाया होता है और छात्रों को सिर्फ पढाई में ही ध्यान देना चाहिये ।छात्रसंघ चुनाव न करवाने के पक्ष और विपक्ष में काफी तर्क दिये जा सकते हैं । पर मुझे खुशी है कि भारत के सभी कालेजों में छात्रसंघ चुनाव पर पाबंदी नहीं है ।
कुछ दिनों पहले पूर्व चुनाव आयुक्त लिंग्दोह साहब की एक याचिका पर सर्वोच्च न्यायालय ने फैसला दिया है कि छात्रसंघ चुनाव में कोई भी प्रत्याशी 5 हज़ार रू से अधिक खर्च नहीं कर सकेगा ।
मेरे अनेक मित्र इस फैसले से नाखुश हैं । वे पूछते हैं कि आम चुनाव में भी तो खर्च पर पाबंदी है पर उसे कौन मानता है ? पर मुझे लगता है कि यह सही दिशा में पहला कदम है ।
पहले हमें यह विश्वास होना चाहिये कि यदि हम अपने वोटरों के बीच काम करें तो जनता से चंदा लेकर कम खर्च में चुनाव लडा जा सकता है । और यह विश्वास स्कूल, कालेज और ग्राम पंचायत के छोटे चुनाव लडने के बाद ही आ सकता है ।
सबसे पुराने ग्राम गणराज्य और लोकतांत्रिक परम्पराओं के पुरातात्विक अवशेष भारत में भी पाए जाते हैं । और हाल के दिनों में भी यदि हमारे पडोसी मुल्कों से तुलना करें तो लोकतंत्र को ज़िन्दा रखने में हम भारत को सबसे आगे पाते हैं और उस पर गर्व कर सकते हैं ।
पर यह भी सच है कि आज का 60 साल पुराना हमारा लोकतंत्र वेंटीलेटर पर है और आक्सीजन की कमी से तडफडा रहा है ।
चुनावों में भारी खर्च इस राजनीतिक अस्थमा का सबसे प्रमुख कारण है । पर पूरे देश में इस विषय पर कोई खास चर्चा होती नहीं दिखती।
पिछले हफ्ते मुझे तब सुखद आश्चर्य हुआ जब रायपुर से चुनावी खर्च पर एक खबर पढने को मिली । इंडिया एब्राड न्यूज़ सर्विस ने राष्ट्रीय स्वयंसेवक संघ में उनके सूत्रों के हवाले से यह लिखा था कि झाडखण्ड हाथ से निकल जाने के बाद छत्तीसगढ की भाजपा सरकार अपने केंद्रीय नेतृत्व से भारी दबाव में है कि छत्तीसगढ सरकार अगले चुनाव के लिये 500 करोड रू पार्टी फंड में दे ।
यह खबर सही है या गलत यह तो पता नहीं । पर इस पर चर्चा ज़रूर होनी चाहिये ।
आदर्श स्थिति तो यही है कि राजनीति समाज के भले के लिये हो । तब इस आदर्श स्थिति को बनाने के लिये यह समाज का ही दायित्व है कि वह इस चुनाव के खर्च का भी बन्दोबस्त करे ।
लोग दबी ज़ुबान में कहते हैं कि विधायक का चुनाव लडने के लिये आजकल लाखों खर्च करने पडते हैं और सांसद के लिये करोड इसलिये धनी ही चुनाव लडते हैं और कम्पनियों से चन्दा लेना आसान है। पर लोग यह भी जानते हैं कि यदि कोई व्यक्ति या कम्पनी चुनाव में चंदा दे रहा है तो वह उसकी रिकवरी भी करेगा । चुनावी चन्दा एक अच्छा इंवेस्टमेंट है ।
इस जानकारी के बावजूद समाज ने राजनीतिक चंदा देने के अपने महत्वपूर्ण दायित्व से मुंह मोड लिया है और बडे राजनीतिक दलों में भी यह विश्वास खत्म हो गया है कि जनता के धन से राजनीति की जा सकती है ।
हमारी चुनावी व्यवस्था जिन देशों की चुनाव पद्धति का अध्ययन करके बनी है उस ब्रिटेन या अमेरिका के किसी भी राजनीतिक दल की वेबसाइट पर यह प्रमुखता से लिखा है कि आप उस पार्टी को चन्दा कैसे दे सकते हैं । पर भारत की किसी भी राष्ट्रीय पार्टी की वेबसाइट में मुझे यह जानकारी नहीं मिली । क्या लोकतंत्र में जनता की राजनीति करने वाले दलों को जनता से चन्दा नहीं चाहिये ?
क्या कानून में कुछ बदलाव की ज़रूरत है ?
1956 के कंम्पनी कानून की धारा 293ए के अनुसार भारत में राजनीतिक दल कम्पनियों से चन्दा ले सकते हैं । 2003 में पारित हुए कानून के अनुसार भारतीय आयकर कानून की धारा 80 जीजीबी के तहत राजनीतिक दलों को दिये चन्दे पर अब आयकर की छूट भी मिलती है ।
पर प्रश्न यह है कि यदि राजनीति आम आदमी के धन से चलने की बजाय सिर्फ कम्पनियों के धन से ही चलेगी तो उस राजनीति पर आम आदमी का कितना नियंत्रण रह जायेगा ?
1951 में बने रिप्रेसेंटेशन आफ पीपल एक्ट के अनुसार प्रत्येक राजनीतिक दल को चन्दे में मिली 20 हज़ार रू से अधिक धनराशि का हिसाब रखना होगा और एक नियत तिथि के पहले उसे चुनाव आयोग के समक्ष प्रस्तुत करना होगा । पर न सिर्फ राजनीतिक दलों के वरन चुनाव आयोग की वेबसाइट में भी इस हिसाब का कोई उल्लेख नहीं मिलता ।
भारत में तो नहीं पर दुनिया के तमाम देशों में चुनावी खर्च के विषय पर गहरी बहस चल रही है । ब्रिटेन में इस विषय पर बनी सर हेडेन फिलिप्स समिति ने 20 अक्टूबर तक जनता की राय जानी है और यह समिति दिसम्बर में अपना फैसला देगी । वहां इस विषय पर वाद विवाद चल रहा है कि क्या सरकार को राजनीतिक दलों को चुनाव के लिये खर्च देना चाहिये । ब्रिटेन में विपक्ष को प्रभावी बनाने के लिये पहले से ही विरोधी दलों को सरकार से धन मिलता रहा है ।
जापान में इस विषय पर काफी बहस के बाद 1993 में कम्पनियों से चुनावी चन्दा गैरकानूनी घोषित कर राजनीतिक दलों को चुनावी खर्च देने का फैसला लिया गया था । अब जापान की सरकार प्रत्येक दल को पिछले चुनाव में मिले प्रत्येक वोट के लिये 250 येन देती है ।
अमेरिका में यद्यपि आम जनता और कम्पनियों से फंड इकट्ठा करने की जबरदस्त प्रथा है पर इसके साथ साथ पिछले चुनाव में सरकार ने अकेले राष्ट्रपति बुश को चुनावी खर्च के लिये 6.4 करोड डालर दिये थे। वहां भी 1999 में किसी भी व्यक्ति द्वारा पार्टी को दिये चन्दे की अधिकतम सीमा 1000 डालर पर सीमित कर दी गयी है ।
छत्तीसगढ में भी गोंडवाना गणतंत्र पार्टी और छत्तीसगढ मुक्ति मोर्चा की तरह राजनैतिक दल मौज़ूद हैं जो आज भी लोगों से चन्दा लेकर चुनाव लडती हैं
क्या छत्तीसगढ में इस पर चर्चा नहीं होनी चाहिये कि 2008 के चुनाव में कौन सी पार्टी कितना खर्च करेगी और वह धन कहां से आयेगा ?

Stop Big Business From Funding Political Parties in India

Recently there has been heated public debate on T.V. about donations being made by corporate sector to various political parties for elections, mainly to congress and B.J.P. and to some others – depending on which area particular company has more stake. Previously there used to be somewhat hesitancy in admitting corporate – political monetary axis. But no longer, one industrialist unashamedly boasting that he gave donations to both the parties but of equal amount. Another donor was more cautions but complained that it should not be disclosed publically - clever thinking because of the uncertainty of which party may come to power. Such cynicism of money power playing a dominant role in the elections and the people accepting it as a normal feature is a matter of grave concern for clean politics.


It is unfortunate that there is almost no public debate on corporate money power muddying the political process in the country. In Companies Act 1913, there was no statutory provision banning donation being made by political parties. The High Courts thus had no option but to hold that donations to political parties could be made, it felt uncomfortable and warned of the of the dangers involved, Chagla C.J. of Bombay High Court warned “It is our duty to draw the attention of Parliament to the great danger inherent in permitting companies to make contribution to the funds of political parties. It is a danger which may grow apace and which may ultimately overwhelm and even throttle democracy in this country.”


Similarly Calcutta High Court warned “Its dangers are manifold. In the bid for political favouritism by the bait of money the company which will be the highest bidder may secure the most unfair advantage over the rival trader companies. Thirdly it will mark the advent and entry of the voice of the big business in politics and in the political life of the country.”


Regrettably Parliament ignored this warning and added in 1960 Sec. 293A to the Companies Act permitting them to contribute to political parties 5% of net profits. The danger signs were visible immediately and Santhanan Committee Report 1962 recommended a total ban on all donations by companies to political parties because of the public belief in the prevalence of corruption at high political levels has been strengthened by the manner in which funds are collected by political parties, especially at the time of elections.


However no action was taken till the Parliament became a more diverse body till 1969 and then Parliament was forced to imposed a total ban on contribution by companies to political parties – Madhu Limaye the Socialist M.P. was the dominant voice for banning corporate funding statement and objects of this amendment were given as follows;


A view has been expressed that such contributions have a tendency to corrupt political life and to adversely affect healthy growth of democracy in the country, and it has been gaining ground with the passage of time. It is, therefore, proposed to ban such contributions.” An attempt made in 1976 to modify the law but failed.


In 1978 the Govt. of India constituted a High Powered Expert Committee to review Companies Act 1956 and Monopolies Act. It was presided over by a judge of Delhi High Court. Amongst its members were some of the top lawyers, Industrials Houses trade Union leaders, and accountants. It unanimously recommended that the ban on donations by companies to political parties should continue. – “The Report worked once this is permitted, the danger the democracy can be well visualized; namely, politics being dictated by the interests of large companies which by the very nature of it, would be able to contribute more funds as compared to the smaller companies.”


Notwithstanding the warning Section 293A was amended in 1985 and Board of Directors was authorized to make donation to political parties. That law still continues. It is unfortunate that while other democracies recognize the danger of money power playing an unhealthy part in Elections, we are still continuing with it. Thus in U.S.A. under the Federal Election Campaign Act 1971 it is unlawful for any corporation to make or for any candidate for president, Vice President, Senate, Congress to receive any contribution is prohibited and it is unlawful for any company to make any contribution to political parties.


It is beyond doubt that contribution by companies is given not because of any ideological reason but really as a device to be in the good books of the ruling party. Thus; between 1966 to 1969, 75 companies paid down Rs. 1.87 crore out of which Rs. 144 lakhs were given to the ruling party, the ruling Congress Party in 1967 alone received Rs. 87 Lakhs.


Perception and reality has not changed – thus we find that in 2003 –n 2004 B.J.P. got 90 crores as against Congress at 65 crores. The peak of BJP was 155 crores in 2004 –05 down to 137 crores in 2007 –08. The rise in the share of the Congress Party during this period was phenomenal uprise starting from 2002 – 03 at 53 crores, upswinging to Rs. 265 crores in 2007 – 08. More significant of Corporate political nexus is illustrated by corporate donation to BSP of Mayawati rising in 2002 – 03 from 10,9 crores to Rs. 55.6 crores in 2007 –08. Does one need more proof of invidious entry of corporate sector in our body politic and of the dangerous consequences.


Another infirmity is the vesting in Board of Directors the power to choose a political party, for giving contribution. Why it is legitimately asked, the decision to utilize corporate funds be determined by a coterie of 10 or 15 Directors rather than that of thousands of shareholders who are the real owners of the company.


A further question relates to the legitimate demands of the workers in the company to have a say for distribution of corporate funds - in (the Supreme Court has recognized their right in funds of the company).


All these problems are bound to become more controversial as actual working of utilization of these funds becomes public. A straightforward, honest, equitable solution is to ban the corporate funding of political parties, as in USA and UK. Clean politics mandates this as a minimum prerequisite by all political parties. Let electorate demand that manifestos of the parties include such a provision - let them give straight answer immediately.

वाल्मीकि व्याघ्र परियोजना

खबर है कि केन्द्र सरकार के ढाई करोड़ की राशि से वंचित होने के बाद भी वाल्मीकि व्याघ्र परियोजना कार्यालय (वाल्मीकीनगर, बिहार) की ओर से वर्ष 2009-10 के लिए नया वार्षिक योजना बनाने की कवायद तेज कर दी गयी है। सूत्रों की मानें वार्षिक योजना पर अंतिम रिपोर्ट अप्रैल माह के अंत तक तैयार कर दिया जायेगा। लगभग 900 वर्ग किलोमीटर में विस्तृत इस परियोजना क्षेत्र का विकास एवं प्रबंधन वार्षिक योजना की राशि से पूरा किया जाता है। समय पर इस राशि के नहीं मिलने से बाघों की सुरक्षा पर प्रतिकूल असर पड़ता है।




स्पष्ट रहे कि वर्ष 2008-09 में वार्षिक योजना के रूप में केन्द्र सरकार ने कुल ढ़ाई करोड़ रुपये की स्वीकृति दी थी। यह स्वीकृति जुलाई माह में मिली, लेकिन बिहार सरकार के लापरवाही के चलते समय पर वाल्मीकि व्याघ्र परियोजना को यह राशि नहीं मिल सकी। इससे जहां एक ओर इतनी बड़ी राशि से टाईगर प्रोजेक्ट को हाथ धोना पड़ा है, तो दूसरी ओर यहां के वनों की सुरक्षा एवं वन प्राणियों के अस्तित्व पर संकट उत्पन्न हो गया है। अगर समय रहते राज्य सरकार की ओर से पहल नहीं की जाती है, तो सुबे का एक मात्र टाईगर प्रोजेक्ट कुछ ही दिनों में नष्ट हो सकता है। इतना ही नहीं राज्य सरकार की लापरवाही के वजह से टाईगर प्रोटेक्शन फोर्स का गठन वर्ष 2008-09 के तहत नहीं हो सका है। वनों की सुरक्षा के लिए नियमित गश्ती भी पिछले चार माह से बंद है। जबकि बाघों की सुरक्षा के लिए केन्द्र सरकार के निर्देश पर प्रत्येक टाईगर रिजर्व क्षेत्र में टाईगर प्रोटेक्शन फोर्स का गठन किया जाना है।



आश्चर्य की बात तो यह है कि मानदेय की राशि नहीं मिलने से सुरक्षा के लिए लगाये गये पांच भूतपूर्व सैनिक नौकरी छोड़ दिये। अब दस भूतपूर्व सैनिक ही अपनी सेवा दे रहे हैं। इधर डीएफओ एस. चन्द्रशेखर की माने, तो भूतपूर्व सैनिकों के मानदेय के भुगतान के लिए गैर योजना मद से चार लाख रुपये दिये गये हैं। इससे उनके एक वर्ष में से मात्र आठ माह का ही वेतन भुगतान हो पाया है। इसके अलावा अतिरिक्त राशि की मांग राज्य सरकार से की गयी है। स्पष्ट रहे कि टाईगर प्रोजेक्ट में सुरक्षा सहित विभिन्न योजनाओं का संचालित करने के लिए केन्द्र सरकार की ओर से प्रति वर्ष वार्षिक योजना की राशि दी जाती है। राशि की स्वीकृति के बाद केन्द्र सरकार के नेशनल टाईगर कंजर्वेशन ऑथारिटी एवं बिहार सरकार के बीच मोड ऑफ अंडरस्टैडिंग कराया जाता है। इसके बाद राशि का इस्तेमाल हो सकता है। आश्चर्य तो यह कि केन्द्र सरकार ने वर्ष 2008-09 के लिए जुलाई 08 में दो करोड़ 50 लाख रुपये स्वीकृत की थी, जिसमें प्रथम किस्त के रूप में उसी माह एक करोड़ रुपये वाल्मीकि टाईगर प्रोजेक्ट को दे दिया गया। लेकिन राज्य सरकार की ओर से एमओयू पर दस्तखत नहीं होने के कारण 31 मार्च बीत जाने के बाद भी उस राशि का इस्तेमाल नहीं किया जा सका। प्रथम किस्त की उपयोगिता प्रमाण पत्र नहीं देने के चलते दूसरी किस्त की राशि से भी हाथ धो लेना पड़ा।




ऐसा नहीं है कि यह घटना पहली बार हुआ। इससे पूर्व भी बिहार सरकार इस तरह की लापरवाही लगातार दिखाती रही है। पिछले आठ वर्षों में केन्द्र सरकार द्वारा जारी फंड और बिहार सरकार द्वारा किए गए खर्चों को देखे तो आश्चर्य होगा। वर्ष 2000-01 में केन्द्र सरकार ने 38.7765 लाख रुपये दिए, पर बिहार सरकार ने सिर्फ 17.73454 लाख रुपये ही खर्च किया। वर्ष 2001-02 में केन्द्र सरकार ने 50 लाख रुपये जारी किए, पर बिहार सरकार सिर्फ 3.75 लाख रुपये ही खर्च कर पाई। वर्ष 2002-03 में केन्द्र सरकार ने 39.15 लाख रुपये उपलब्ध कराए, और बिहार सरकार ने इसे पूरा खर्च कर दिया।
वर्ष 2003-04 में केन्द्र सरकार ने 50 लाख रुपये दिए, और बिहार सरकार ने खर्च किया 77.828 लाख रुपये। वर्ष 2004-05 में केन्द्र सरकार ने 85 लाख रुपये दिए, बिहार सरकार ने सिर्फ 42.7079 लाख रुपये ही खर्च किया। वर्ष 2005-06 में केन्द्र सरकार ने कोई फंड उपलब्ध नहीं कराया, लेकिन बिहार सरकार ने 73.2290 लाख रुपये खर्च किए। वर्ष 2006-07 में केन्द्र सरकार ने 63.9554 लाख रुपये दिए, और बिहार सरकार ने 73.8575 लाख रुपये खर्च किया। वर्ष 2007-08 में केन्द्र सरकार ने 92.810 लाख रुपये दिए, और बिहार सरकार ने 66.9436 लाख रुपये खर्च किया।



यह सारे आंकड़े भारत सरकार के पर्यावरण व वन मंत्रालय के नेशनल टाईगर कंजरवेशन ऑथोरिटी से लेखक द्वारा डाले गए आर.टी.आई. के माध्यम से प्राप्त हुए हैं। मंत्रालय ने यह फंड बिहार के वाल्मीकी टाईगर रिजर्व के विकास एवं संरक्षण हेतु उपलब्ध कराए थे।
